Egg Donation Agreements

Egg Donors are extremely compassionate women who want to assist Intended Parents in creating a family they otherwise would not be able to have. While it is wonderful that there are so many women willing to provide such a tremendous gift, it is important that the parties enter into a comprehensive and clear Egg Donation Agreement to outline the rights and responsibilities of all parties participating in an egg donation cycle.

Among the many issues that need to be addressed in a comprehensive Egg Donation Agreement, one critical issue that the agreement will confirm is that the Intended Parents, and not the Egg Donor, will be the legal parent(s) of any child conceived through the egg donation process. Equally important, the Egg Donation Agreement will clarify that the Egg Donor has no responsibilities toward any such child and that there are no rights of inheritance between the Egg Donor and the child.

Whether matched through an agency or working with a family member or friend, whether the donation is open, semi-open or anonymous, we strongly advise that all Intended Parents and Egg Donors enter into an Egg Donation Agreement prior to the IVF cycle. In fact, most IVF clinics require “legal clearance” that a valid Egg Donation Agreement has been entered into between the parties prior to the commencement of any medications for the Egg Donation cycle.
