Embryo donation agreements:

IVF involves the creation of embryos, many of which will remain cryopreserved after the parents have completed their family. Some parents will opt to discard the remaining embryos or to donate them for medical training or scientific research, but many will want to donate the embryos to another family for the purpose of having a child.

Recipient Parents are those who are receiving embryos from Embryo Donor(s), including those families who matched independently and those who are matched through their IVF Clinic or an Embryo Donation agency. Embryo Donors are those who are donating unused embryos from their own IVF cycle to the Recipient Parents with the intention that the Recipient Parents will become the legal parents of any child conceived with the donated embryos.

While some states have laws that address the legalities of Embryo Donation, others have no laws on Embryo Donation at all. In either case, having an Embryo Donation Agreement in place to define the rights and responsibilities of both the Embryo Donors and the Recipient Parents is crucial. Regardless of whether we are representing Recipient Parents or Embryo Donors, we are sensitive to not only the legal issues but also to the unique familial ties between the parties who will potentially have children that are genetic siblings.
