Sperm Donor Agreements:
Many Intended Parents, including same-sex female couples, single mothers by choice, and others, need the assistance of a Sperm Donor to build their family. Most states have had laws governing sperm donation for decades. However, these laws are quite vague and do not address many of the issues that can arise with sperm donation. As such, we strongly advise both the recipients of donor sperm, (the Intended Parents) as well as the Sperm Donor enter into a comprehensive Sperm Donor Agreement before they participate in any insemination or other assisted reproductive procedure.
A well drafted Sperm Donor Agreement will define, in detail, the rights and responsibilities of all parties participating in the sperm donation arrangement, whether through a fertility clinic or an at-home insemination. As many state’s laws are “intent-based” laws, the Sperm Donor Agreement is critical to defining everyone’s intentions that the Intended Parent(s) shall be the legal parents of the child and that the Sperm Donor shall not be a parent and shall have no rights or responsibilities to the child.
Regardless of whether we are representing Intended Parents or Sperm Donors, because sperm donor agreements are often entered into between friends/family, we are sensitive to not only addressing the legal issues but also ensuring that the relationship is preserved.
