Gestational Surrogacy agreements

We have extensive experience representing both Intended Parents and Gestational Surrogates in Gestational Surrogacy Agreements, including those who have matched independently or through an agency.


Genetic surrogacy agreements

Genetic Surrogacy Agreements differ from Gestational Surrogacy Agreements in that a Genetic Surrogate is one of the genetic contributors to the child. We have experience representing both Intended Parents and Genetic Surrogates in the drafting and negotiation of Genetic Surrogacy Agreements. Genetic Surrogacy Agreements present unique legal issues and require special attention, and often a different legal process than a gestational surrogacy arrangement.


Egg Donation Agreements

We have extensive experience representing Intended Parents and Egg Donors in the preparation and review of a directed Egg Donor Agreement. Whether the Egg Donor is known or the parties are anonymous and matched through an agency, we can ensure that your Egg Donor Agreement clearly outlines everyone’s rights and responsibilities under the contract and complies with applicable state law.


Sperm Donor agreements

We have extensive experience representing Intended Parents and Sperm Donors in the drafting and negotiation of Sperm Donor Agreements in anonymous, semi open, and known arrangements.


Embryo Donation Agreements

When parents have remaining cryopreserved embryos after completing their family, many will want to donate them to another family. We have extensive experience representing both Recipient Parents and Embryo Donors in the drafting and negotiation of Embryo Donation Agreements.


Parentage Orders

We have extensive experience in obtaining parentage orders for Intended Parents working with a Gestational Surrogate. In fact, our firm was the first law firm to successfully obtain the first parentage order for a same-sex male couple using and Egg Donor and Gestational Surrogate.

The Parentage Order process involves petitioning the court prior to the birth of a child in order to have the Intended Parents declared the legal parents of their child and having their names placed on the child’s birth certificate (often referred to as a Pre-Birth Order). In some situations, obtaining a Parentage Order after the birth is advisable or necessary. We can help obtain Post-Birth Parentage Orders either on its own or in addition to a Pre-Birth Order.


Escrow Management

Clients may elect to use our services to manage all fee and expense payments to their Egg Donor and/or Gestational Carrier, allowing clients to focus on the more important aspects of the relationship with their Egg Donor and/or Gestational Carrier.  


Fertility Insurance Appeals

Fortunately, many states provide insurance coverage for IVF and other forms of assisted reproductive technology. However, in far too many cases, insurance companies wrongly deny coverage for such treatments, especially in cases where a third party, such as a donor or surrogate is needed. We assist clients in fighting insurance denials related to fertility treatments, surrogacy, or donor arrangements.


Estate Planning

We help Intended Parents create estate plans to protect their family’s future, including wills, trusts, and guardianship designations tailored to their unique fertility journey.
